Man spared jail - again

A WORKSOP man was in breach of a suspended sentence when he punched a man outside a takeaway.

David Battey’s victim Bill Whelan suffered a cut to his chin, Notts Crown Court heard.

Battey, 38, of Gateford Road, had a history of violence but was spared prison after the court heard the offence was over a year old and he was on medication.

He admitted the common assault, which happened last year outside Speedy Peppers in Worksop.

He claimed Mr Whelan had been drunk and had come up to him, said Steven Taylor, prosecuting.

In 2009 Battey got a nine month prison sentence suspended for two years for punching a man a number of times. He was given a community order with 18 months probation supervision.
