Brinsley man jailed after drunken smash-up of brother's car

Samuel Arthur Kelham, 28, of Cherry Tree Close, admitted causing criminal damage when he appeared at Mansfield Magistrates Court on Thursday.

The court heard Kelham damaged the door panel and smashed the window of a Vauxhall Insignia, parked outside his brother’s Cherry Tree Close, address where he had been staying, at around 2am on September 4.

Neil Hollett, prosecuting, said: “The defendant’s brother states he and his family have had a lot of problems when the defendant is in drink.

“The defendant was interviewed and said he couldn’t recall exactly what had happened.

“When the police were called he jumped out of a bedroom window and tried to escape.”

Sarah Neale, mitigating, said Kelham had apologised and pledged to fix the damage.

She said he recently moved to the Southport area with his partner and returned to Nottinghamshire in the week to work as a ground-worker.

“He was extremely intoxicated,” she said. “He had a dispute with his partner. He tried to go home but was dragged out again by his friends.

“This made a bad situation worse.”

The court heard Kelham was the subject of an 18-month suspended sentence.

Sarah Alderton, of the probation service, reported that Kelham didn’t want to attend a building better relationships course and his attitude was ‘very negative and anti-social.’

She said the previous offence had been committed under the influence of alcohol and he was unsuitable for a curfew due to previous domestic incidents.

District Judge Andrew Meachin activated the 12-week suspended sentence and imposed a four week sentence to run concurrently, giving Kelham a total of 16 weeks.

He was also ordered to pay a £115 victim surcharge.
